1. Privacy & Data Commitment

FaceofMind prioritizes your privacy. Images may be captured on your device and securely transmitted to our servers for emotion analysis. Data is protected with encryption in transit and at rest. For more details, refer to our Privacy Policy.

2. Data Security & Breach Notification

We implement industry-standard technical and organizational safeguards to protect user information, including encryption at rest and in transit, access controls, and audit logging. Additional details are available in our Privacy Policy and Trust Center. In the event of a data breach, we will notify affected users within 72 hours of discovery (or per applicable law, whichever is sooner).

3. AI Model Accuracy, Limitations & Disclaimers

FaceofMind is not intended to diagnose, treat, or cure any mental health condition. This app is a mental health awareness tool, not a replacement for licensed healthcare professionals. Always seek professional advice if you're experiencing emotional or psychological distress.

For licensed mental health professionals:

• FaceofMind is a supplemental tool, not a substitute for clinical judgment.
• You are solely responsible for all clinical decisions made with or without the platform.
• FaceofMind does not provide medical advice, diagnosis, or treatment.

🤖4. Third-Party AI Services

FaceofMind uses advanced Large Language Models (LLMs) and speech prosody analysis to process voice journal transcripts and vocal tone characteristics. Voice recordings are processed in accordance with our strict data compliance and security policies. Refer to our Privacy Policy for more details.

5. Optional Therapist Integration (QR Handshake)

If you connect to a psychologist via our QR code handshake features:

• You are providing explicit consent to share your mood history, voice analysis metrics, emotion detection indicators, and journal themes.
• You can disconnect or pause sharing at any time in the app settings (Settings → Therapist Access).
• Past shared data remains available to your therapist to ensure continuity of care. You can request deletion of shared logs through legal procedures.

6. Enterprise & Hospital Users

If you are utilizing FaceofMind as a health system, clinic, or hospital:

• Standard consumer terms apply, PLUS all enterprise terms set forth in your executed Data Processing Agreement (DPA) and Business Associate Agreement (BAA).
• Service Level Agreements (SLAs) regarding uptime, support turnaround, and escalation procedures are documented separately.
• Where applicable, enterprise deployments are designed to support compliance with applicable healthcare privacy laws and contractual obligations, including HIPAA, GDPR, and RA 10173.

👥7. User Conduct

By using FaceofMind, you agree not to:

• Post, transmit, or share harassing, abusive, threatening, or violent content.
• Upload sexually explicit, hateful, discriminatory, or illegal content.
• Impersonate others or misrepresent your identity.
• Interfere with or disrupt the app's functionality or security.
• Reverse-engineer, scrape, or exploit the app or its AI systems.
• Perform automated scraping, excessive API requests, credential stuffing, or attempts to circumvent rate limits.
• Use the app to self-harm, promote suicide, or engage in dangerous behavior.

You must be 13 years or older to use FaceofMind. If you are under 18, use of the app must be with parental or guardian consent.

10. Account Termination & Data Deletion Timelines

We may suspend or terminate accounts that violate these terms, engage in harmful behavior, or misuse the platform. Upon account deletion or termination, we commit to the following data purging schedule:

• All mood logs deleted within 30 days
• All journal entries & voice recordings deleted within 30 days
• Activity logs deleted within 30 days
• Consultation records retained for 7 years (legal/compliance requirement)

11. Suspension for Security Reasons

FaceofMind may temporarily suspend accounts, sessions, or access where reasonably necessary to investigate suspected fraud, abuse, security incidents, or legal violations. We will attempt to provide notice before or promptly after any suspension, unless doing so would compromise security or violate legal obligations.

12. Beta & Preview Features

Certain experimental features may be labeled "Beta" or "Preview." These features are provided for evaluation purposes, may change or be discontinued without notice, and may not perform as expected. Beta features are provided "AS IS" without any warranties, and we are not liable for any issues arising from their use.

©️13. Intellectual Property & User Content

FaceofMind and its logos, software, and content are owned by us or our licensors. You retain ownership of content you submit, but grant us a limited license to process it solely to operate the service. We respond to copyright infringement notices under applicable law.

14. Governing Law & Dispute Resolution

These Terms are primarily governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. For users in the United States, disputes and claims arising under local state privacy laws or commercial agreements will be governed by the laws of the State of Delaware and the federal laws of the United States upon Delaware parent incorporation. Any dispute arising from these Terms or your use of FaceofMind shall first be addressed through good-faith negotiation. If unresolved, disputes may be submitted to binding arbitration: (a) in Cebu City, Philippines, under the rules of the Philippine Dispute Resolution Center for domestic matters, or (b) in Wilmington, Delaware, USA, under the rules of the American Arbitration Association (AAA) for US/global matters (active only upon Delaware parent company incorporation). Prior to parent incorporation, all global/US arbitration proceedings will be conducted in Cebu City, Philippines, under domestic arbitration rules, unless mandatory consumer protection law in your jurisdiction requires otherwise.

FaceofMind is provided "AS IS" and "AS AVAILABLE" without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or completely secure.

16. Limitation of Liability

To the maximum extent permitted by Philippine law, FaceofMind and its founders, employees, and contractors shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data. **Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months before the claim, or ₱50,000, whichever is greater, except where liability cannot be limited by law (e.g., personal injury, death).**

You agree to defend, indemnify, and hold harmless FaceofMind from claims, damages, losses, and expenses arising from your violation of these Terms, misuse of the app, or infringement of another person's rights.

🌪️18. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, pandemics, internet outages, or failures of third-party infrastructure providers.

📄19. Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy and any policies referenced herein, constitute the entire agreement between you and FaceofMind regarding the service.

🔄20. Changes to Terms

We may update these Terms of Service periodically. We will post the updated version with a new "Last updated" date. Continued use after material changes constitutes acceptance where permitted by law.
